Your rights with Debt Collectors

Many consumers feel scared to deal with the debt collectors. And this is because they lack knowledge about them which subsequently attributes a wrong concept about them. Many people think dealing with debt collectors is like dealing with someone who has the right to abuse them physically and emotionally, which however is a myth.  


According to the FDCPA (Fair Debt Collection Practices Act), a debt collector is required to carry a fair debt collection regardless of the debt amount, the exceeding due periods or anything else. A debt collector is fairy neither allowed to force you to do anything nor allowed to treat you unfairly.


When it comes to debt collections, even you have certain rights to protect yourself from any misleading behaviors. So, read the following points and be aware of your rights to protect yourself from harassments.

Here are the basic provisions of law that include –

  • A consumer has the right to sue a debt collector for violation of law.

  • According to the FDCPA, you can protect yourself against harassments including excessive phone call, abusive language, threats of violence etc.

  • Debt collectors are prohibited to disclose the debt amount to anybody else.

  • The collection agency (or debt collector) is only allowed to meet consumers during the time frame of 8am-to 9pm. You can simply deny meeting at inconvenient times such before 8am and after 9 pm.
